Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the Regulatory Exams Practice application (the “Service”) operated by Active Wave Group Pty Ltd (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
1. Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. Educational Purpose
This Service is provided for educational and exam preparation purposes only. While we strive to provide accurate and up-to-date information, we make no guarantees about:
- The accuracy or completeness of the content
- Your success in passing any regulatory examination
- The relevance of content to current regulatory requirements
- The suitability of the content for your specific needs
You acknowledge that successful completion of practice tests on this platform does not guarantee success in actual regulatory examinations.
3. Subscriptions and Payments
Subscription Plans
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or 90-day basis, depending on the type of subscription plan you select when purchasing a Subscription.
Free Trial
Active Wave Group Pty Ltd may, at its sole discretion, offer a Subscription with a free trial for a limited period of time (“Free Trial”).
You may be required to enter your billing information in order to sign up for the Free Trial. If you do enter your billing information when signing up for the Free Trial, you will not be charged by Active Wave Group Pty Ltd until the Free Trial has expired.
Fee Changes
Active Wave Group Pty Ltd, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
Refunds
Except when required by law, paid Subscription fees are non-refundable. However, we may consider refund requests on a case-by-case basis within 7 days of purchase if you have not substantially used the Service.
4. Content
Our Content
The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Active Wave Group Pty Ltd and its licensors.
Your Content
Our Service may allow you to post, link, store, share and otherwise make available certain information, text, graphics, or other material (“Content”). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.
By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service.
5. Prohibited Uses
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates any applicable national or international law or regulation
- To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
- To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service
- To share your account credentials with others
- To reproduce, distribute, or create derivative works from the Service content for commercial purposes
- To use automated systems or software to extract data from the Service (“scraping”)
6. Intellectual Property
The Service and all contents, including but not limited to text, images, graphics, logos, and software, are the property of Active Wave Group Pty Ltd or its content suppliers and are protected by South African and international copyright, trademark, and other intellectual property laws.
7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
8. Limitation of Liability
In no event shall Active Wave Group Pty Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use or alteration of your transmissions or content
- Failure to pass any regulatory examination despite using the Service
9. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
12. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

By using the Service, you acknowledge that you have read these Terms of Service and agree to be bound by them.
